I don't know enough about the Australian justice system, but I don't understand the emphasis on the Coroner that the article mentions. This type of thing happens in the US all the time. Someone gets no bail (Personal Recognizance) or a very small bail, and goes out and commits another crime. That's why I personally hate the term "Judicial Discretion".

People use that term based on not understanding that there is also a minimum burden to prove before they will set bail. A lot of the time (behind the scene fourth wall break!)? The prosecutor has very little besides circumstantial proof. Or it is a bad prosecutor who is HORRID at his job.
